Your use of the website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers set out below (“Terms and Conditions”). You should read them now. Your use of the website constitutes your agreement to the Terms and Conditions.

Nannup Hardware and Agencies reserves the right to amend the Terms and Conditions at any time and without notice to you. Your continued use of the website after any amendment becomes effective constitutes an agreement by you to abide and be bound by the Terms and Conditions, as so amended.

Orders & Contracts

Any order placed in the manner described in this website is an offer to purchase a particular product for the price (including the delivery and other charges and taxes) specified in this website at the time the order is placed on these Terms and Conditions. Nannup Hardware and Agencies reserve the right to accept or reject an offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in the order. The contract with us only comes into existence when it forwards confirmation of receipt of your order and payment.


Prices quoted on the Nannup Hardware and Agencies website are quoted in Australian Dollars (AUD). Prices of products and services and delivery and other charges displayed on this website are current at the time of issue but may change at any time and are subject to availability.

Goods and Services Tax (GST) and Other Taxes

Prices displayed on this website are inclusive of GST.

Limitation of Liability

Nannup Hardware and Agencies will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from use or inability to use the website or for the cost of procurement of substitute products or resulting from any products purchased or obtained or messages received or transactions entered into through the website or resulting from unauthorized access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if we have been advised of the possibility of such damages.

Where any Act of Parliament implies in the Terms and Conditions any term, condition or warranty, and that Act avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in the Terms and Conditions, however, the liability for us on any breach of such term, condition or warranty shall be limited, at our option, to any one or more of the following:

If a breach relates to goods:
  • the replacement of the goods or supply of equivalent goods
  • the repair of such goods
  • the payment of the cost of replacing the goods or of acquiring equivalent goods
  • the payment of the cost of having the goods repaired
If a breach relates to services:
  • the supplying of the services again
  • the payment of the cost of having the services supplied again 

Where the Product is being delivered, the Seller will use reasonable endeavours to deliver Products within the time frame shown.

Sellers are unable to accept liability for delay in delivering goods which is beyond their reasonable control (e.g. if stock is unavailable). If the Product has not been delivered within a reasonable time (depending on the nature of the Product and the delivery address), please contact us if you wish to cancel your order for that Product and request a refund.

You must ensure there is clear and safe access for delivery. Please ensure there is a person present at the delivery premises who is authorised by you to accept delivery. If there is not, the Seller will endeavour to deliver the Product if safe and appropriate to do so. If the delivery person arrives at the agreed time but is unable to deliver the Product or considers that it is unsafe or inappropriate to do so, you may be required to pay for re-delivery later, or the Seller may cancel your order and provide you with a refund.

Some Products may require extra delivery personnel which may incur an additional charge as advised to you before you submit your order. The Seller will deposit your goods at ground level at the delivery premises unless you have arranged otherwise with the Seller. The goods are at your risk after delivery.


Risk of loss and damage to the Goods passes to the Customer upon the Goods leaving The Seller’s premises whether or not The Seller arranges delivery.


Pickup of goods is not available outside of stated opening hours.

Cancellation by Seller

The Seller may cancel any order (in full or part) where: (i) you are in breach of your payment obligations; (ii) the Seller reasonably suspects that you are purchasing goods for the purposes of resale or resupply; (iii) the Seller becomes aware after order confirmation that the good is out of stock; (iv) there has been a genuine pricing or product description error; or (v) where the transaction is suspected of being the subject of credit card or payment-related fraud. The Seller will refund any amount already paid in respect of any cancelled order. In the case of part cancellation of an order, a refund will be provided on the amount paid that relates to the cancelled portion of the order. 

Refunds & Returns 

Some goods, including custom made goods may not be returnable unless a warranty or guarantee is breached.
